USA EB-5 Immigrant Investor Program

One of the most popular programs at the moment is the US Immigrant Investor Program (EB-5), which grants US green card to investors who make a US$900,000 in a job-creating project. Known the world over as the land of opportunity, the United States of America boasts a rich and diverse culture, one of the strongest currencies in the world, and one of the most sought-after passports on the planet. Through the USA EB-5 Immigrant Investor Program, applicants can enjoy a host of exclusive benefits including:

USCIS administers the EB-5 Program. Under this program, entrepreneurs (and their spouses and unmarried children under 21) are eligible to apply for a green card (permanent residence) if they:

  • Make the necessary investment in a commercial enterprise in the United States; and
  • Plan to create or preserve 10 permanent full-time jobs for qualified U.S. workers.

This program is known as EB-5 for the name of the employment-based fifth preference visa that participants receive.

Congress created the EB-5 Program in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors. In 1992, Congress created the Immigrant Investor Program, also known as the Regional Center Program. This sets aside EB-5 visas for participants who invest in commercial enterprises associated with regional centers approved by USCIS based on proposals for promoting economic growth.

Capital Investment Requirements

Capital means cash, equipment, inventory, other tangible property, cash equivalents and indebtedness secured by assets owned by the alien entrepreneur, provided that the alien entrepreneur is personally and primarily liable and that the assets of the new commercial enterprise upon which the petition is based are not used to secure any of the indebtedness. All capital shall be valued at fair-market value in United States dollars. Assets acquired, directly or indirectly, by unlawful means (such as criminal activities) shall not be considered capital for the purposes of section 203(b)(5) of the Act.  The minimum qualifying investment either within a high-unemployment area or rural area in the United States is $900,000.

Quebec Immigrant Investor Program (QIIP)

Through the Quebec Immigrant Investor Program (QIIP), which was established as a means of promoting economic growthwe help investors and their families to immigrate to Quebec, Canada, by placing their funds in a five-year government guaranteed investment.

For the QIIP submission, the following criteria have been established:

  • The investment amount is $1,200,000 and the applicant must intend to settle in Quebec. We offer an affordable financing option in lieu of the $1,200,000 five-year deposit.
  • The minimum net worth requirement is set at $2,000,000 alone or including the accompanying spouse.
  • The applicant must have management experience for at least 2 years of the last 5 years preceding the submission.
  • The exception for applicants proving an intermediate-advanced level of French is still applicable and is not subject to quota limitation.

Note: The intake of permanent selection applications under the Investor Program was initially suspended from November 1, 2019 to March 31, 2021 in order to allow time for the program to be reviewed. Subsequently, by way of ministerial decree, Quebec’s Minister of Immigration, Francisation et Integration, announced in March 2021 that the Quebec Immigrant Investor Program (QIIP) would continue to remain on hold. Therefore, the QIIP is still on hold as the Province conducts a review of the program, and works on modifications and improvements. While the announcement made in March 2021 allows for the program to be on hold until March 31, 2023, we believe that the Province will publish regulatory updates for the QIIP well in advance of this date.
